According to the results of 2013-2014, LLC Wrigley Ukraine (a company that is part of the Mars group selling well-known brands of chewing gums and sweets) had a significant overpayments (almost UAH 28 million) related to advance income taxes, which were subject to payment under current legislation.
At the same time, the tax authorities did not recognize this overpayment and as a result LLC Wrigley Ukraine incurred a tax debt that the tax authorities demanded to pay. LLC Wrigley Ukraine was forced to go to court to oblige the tax autorities to recognize the overpayment, as well as to appeal against numerous illegal claims for tax debt.
After many years of work, the SDM Partners team (specificately Dmytro Syrota, Mykola Melnyk and Serhiy Dzis) used all possible legal actions to defend the rights and interests of LLC Wrigley Ukraine and finally, we are pleased to announce a complete victory in all areas.
The legitimacy of the position of the foreign investor was confirmed by all levels of the judiciary, and the court decisions were actually enforced.
