Reservation Only For Enterprises With Updated Criticality

Starting from 01 April 2025, deferrals granted to employees liable for military service by decisions of the Ministry of Economy or through the Diia portal on the basis of reservations by enterprises that have not yet updated their criticality status will cease to be valid.

Only enterprises that have already updated their criticality status in accordance with the new requirements will be able to continue the reservation of their employees from that date.

The general rule is that in order to obtain the critical enterprise status, the following three criteria must be met:

  • Mandatory criteria:
    • the average salary at the enterprise is at least UAH 20 thousand;
    • no tax and unified social contribution arrears.
  • Optional criteria (the enterprise must choose one of these criteria):
    • payment of taxes and duties in the amount of more than EUR 1.5 million per year in the equivalent in hryvnias at the NBU exchange rate;
    • foreign currency earnings in the amount of more than EUR 32 million per year, excluding loans and borrowings;
    • importance for a particular sector of the economy or the needs of the territorial community (criteria are determined by the relevant state authorities, regional military administrations);
    • status of a resident of Diia.City;
    • provider of electronic communication services using mobile networks with an average monthly net income of more than UAH 200 million;
    • provider of electronic communication services using fixed-line networks with an average monthly net income of more than UAH 200 million.

Status of a critical enterprise

Obtaining the status of a critical enterprise takes place in several stages:

  1. Defining the relevant authority (Ministry of Energy, Ministry of Digital Transformation, Ministry of Agriculture, etc.)
  2. Preparing and submitting documents (financial reports, salary and tax certificates).
  3. Submitting an application to the relevant authority and receiving a decision (up to 10 working days).

After updating the criticality status, an application must be submitted through the Diia portal to reserve employees, which is done as follows:

  1. Log in to the Diia portal.
  2. Select the “Бронювання працівників” (Employee reservation) service and click “Подати заяву” (Submit application).
  3. Enter the required employees data.
  4. Confirm their salary level.
  5. Sign the application and wait for the result within 72 hours.

The confirmed reservation will be displayed in the “Резерв+” app and will be valid for the period of criticality – up to 1 year.
