New Rules For Trade Services

On 11 February 2025, the Cabinet of Ministers adopted Resolution No. 144 approving the Rules for Trade Services, which will establish general requirements for trade services and conditions for business entities to carry out trade and production and trade activities, as well as basic requirements for retail premises.

The new Rules will come into force simultaneously with the entry into force of the Law of Ukraine No. 3153-IX “On Consumer Protection” dated 10 June 2023 – on the day of termination or cancellation of martial law.

Among other things, the Rules provide for the following important changes:

  • The placement of mobile retail premises should not interfere with the unimpeded access of persons with disabilities and other groups with reduced mobility to the physical environment, transport and other facilities.
  • Retail premises must be adapted to the needs of persons with disabilities and other groups with reduced mobility in accordance with the law.
  • Business entities will be able to place a QR code with information from the consumer’s corner on the name of the business entity, its location, telephone numbers, official websites of state and local government bodies that protect consumer rights, the date of issue and validity of the licence (if any) for the right to wholesale or retail trade in alcoholic beverages, tobacco products, liquids used in electronic cigarettes, which is licensed in accordance with the law, at any accessible place. In this case, if a QR code is placed, the business entity is obliged to provide such information in paper form for review at the request of the consumer.
  • Measuring instruments used in trade and production and trade activities must comply with the requirements of the legislation on metrology and metrological activities.
  • It is prohibited to sell goods that imitate food products (have their shape, smell, colour, appearance, packaging, labelling, volume, size or other characteristics) and endanger the safety or health of consumers, in particular children, who may confuse them with food, put them in their mouths, suck or swallow them.
  • Business entities shall equip a separate room (place) for storing outerwear and personal belongings of its employees.
  • Business entities engaged in network trade must have premises for receiving, storing and preparing goods for sale (office and warehouse premises) and sell them through network trade agents at the location of the consumer or using delivery services. In this case, the responsibility for the safety of the goods sold lies with the business entity that carries out network trade.
  • Business entities that sell through an online store are obliged to provide the consumer with the information specified in the Laws of Ukraine “On Electronic Commerce” and “On Consumer Protection”, and may also provide services of a trading platform (marketplace), services of an electronic classifieds service provider and services of an electronic product comparison service provider (price aggregator).
