Mandatory e-Cabinet in the UJS, E-Service for Reservation Employees from Mobilization

The Law on Mandatory Registration of the e-Cabinet in the Unified Judicial System has been Published

On 20.07.2023, Law of Ukraine No. 3200-IX was published in the newspaper “Voice of Ukraine”, which provides, inter alia, the obligation for all legal entities under private law, lawyers, notaries, public and private executors, state authorities, local self-government authorities to register their electronic cabinets (accounts) in the Unified Judicial Information and Telecommunications System or in its separate subsystem – the Electronic Court.

Thus, the Law enters into force on the day following its publication, but officially its provisions begin to apply 90 days after its publication.

At the same time, the provisions of the Law regarding the mandatory registration of e-cabinets for legal entities of private ownership enter into force 7 months after the date of publication of the Law.

It should also be noted that cases, the proceedings of which were opened before the entry into force of this Law, have to be also considered according to the new rules provided by the Law.

The Activity of Separate Divisions of a Legal Entity under the Law of a Foreign State have been Regulated

On 14.07.2023, the Verkhovna Rada adopted as a whole the law (draft law No. 4482), which provides for a comprehensive approach to the settlement of all aspects of legal relations (civil, labor, financial) related to the creation and termination of separate divisions of a legal entity (branches and representative offices) under the law of a foreign state.

Thus, the law provides for the following:

  • such branches and representative offices are subject to state registration in accordance with the procedure established by law for state registration of Ukrainian legal entities and public formations without the status of a legal entity. Termination of such branches and representative offices is carried out by liquidation;
  • data on the creation and termination of branches and representative offices are entered into the USR;
  • the creation of branches and representative offices of a legal entity under the law of an aggressor state is prohibited;
  • the fee of one subsistence minimum for able-bodied persons (currently 2,684 UAH) is established for the state registration of a separate divisions of a legal entity under the law of a foreign state (except for separate divisions of a foreign non-governmental or charitable organization), and the fee of 0,3 of the subsistence minimum (805 UAH) – for state registration of changes.

The Ministry of Economy Announced an Electronic Service for Reservation Employees from Mobilization

As Ukrinform reports, this was announced by Ihor Fomenko, Deputy Minister of Economy, during a meeting of the European Business Association with representatives of the Ministry of Economy.

Thus, according to the Deputy, it is planned to develop a service that will allow an enterprise to create its own e-cabinet, which will contain information about its employees and their military accounting specialty. Herewith, all the necessary information will be pulled automatically from the data of the Pension Fund and the Tax Service of Ukraine.

According to the results of the procedure, as well as on the condition that there are no various restrictions and inconsistencies, enterprise’s employees will be automatically reserved and the corresponding document-confirmation will be issued to them. Such an electronic document will contain a QR code, and it can also be printed.
