Accounts in Electronic Court, Sanctioned Assets sale, the Status of the English Language

State Authorities and Private Legal Entities will be Required to Register in the Electronic Court

On 29.06.2023, the Verkhovna Rada adopted in the second reading Draft Law No. 7574-d, which provides for the obligation of state authorities, lawyers, notaries, as well as all legal entities, regardless of the form of their ownership, to register their electronic cabinets (accounts) in the Unified Judicial Information and Telecommunications System (UJITS) in order to be able to act as a party to the court process in the future.

The court will dismiss the claim without consideration of a legal entity who, according to this law, should have registered an electronic account in UJITS but did not do so.

Thus, the draft law, if finally adopted, may in fact deprive legal entities of the ability to participate in the court process (including through a representative), provided they do not have a personal account in the Electronic Court.

Changes to the Procedure for Registration Suspension of Tax Invoice are Expected to Enter into Force

On 08.07.2023, Cabinet’s Resolution No. 574, amending Resolution No. 1165 “On Approval of Procedure for registration suspension of tax invoice/ adjustment calculation in the Unified Register of Tax Invoices”, will enter into force.

Let us please remind you that, among other things, the changes include:

  • automatic registration of tax invoices/ adjustments in case the taxpayer is removed from the risk list;
  • automatic registration of suspended tax invoices/adjustments if the tax authorities accept the taxpayer’s data table.

The State Property Fund will sell Sanctioned Assets: the Law was Signed by the President

On 20.06.2023, the Law (draft law № 3137-IX) on Amendments to the Law of Ukraine “On the State Property Fund of Ukraine” (the Fund) was returned with the signature of the President, which actually allows the Fund to start procedures for the sale of assets of legal entities / persons subject to sanctions.

Thus, in accordance with the adopted law, the Fund will operate with the assets of sanctioned legal entities and residents of the aggressor country, which were confiscated into state income, and which were transferred to the Fund by decision of the High Anti-Corruption Court.
The activities of the Fund regarding confiscated assets are regulated by Cabinet’s Resolution No. 125, according to which the sale of sanctioned assets must be carried out only through public electronic auctions in the Prozorro system.

The funds from the sale of such assets will be transferred to the Fund for the Liquidation of the Consequences of Armed Aggression.

Draft Law on the Status of the English Language in Ukraine has been Submitted to the Verkhovna Rada

On 28.06.2023, the President of Ukraine introduced draft law No. 9432 “On the use of the English language in Ukraine” to the Verkhovna Rada.

The document proposes:

  • to officially establish the status of English as one of the languages of international communication in Ukraine;
  • determine the categories of officials for which is required to speak English.

The Electronic Excise Stamp will Start Operating in Ukraine from Jan 2026

On 29.06.2023, the Verkhovna Rada adopted in the second reading draft law No. 8287 on amendments to the Tax Code of Ukraine and other laws in connection with the introduction of the electronic excise stamp and digital traceability system “eExcise”.

As reported by the Ministry of Digital Transformation, the implementation of the eExcise electronic system using Track & Trace technology will allow tracking the route of all tobacco and alcohol products.

It is provided that each product will have an electronic excise stamp expressed by a two-dimensional DataMatrix code. Manufacturers and importers will be able to independently generate it in the eExcise digital traceability system and apply it to each individual product.

The law will also allow consumers to verify that products are not counterfeit just by scanning an electronic excise stamp through the Diya app.

Thus, the electronic excise stamp and the traceability system will start operating in Ukraine from January 2026.
