Six Months Left to Amendments of the Rules of Importation of Animals and Products in Ukraine

The Ministry of Agrarian Policy has defined new requirements for importing animals and products in Ukraine.

The relevant order “On Approval of Requirements for the Importation (Transfer) into the Customs Territory of Ukraine of Live Animals and their Reproductive Material, Food of Animal Origin, Feed, Hay, Straw, as well as Animal By-products and Products of their Processing, Processing” of November 16, 2018 No. 553 was registered with the Ministry of Justice on April 4, 2019. The order will take effect six months after publication.

The main purpose of the development and adoption of the order was determined by the need for systemic review and updating of current requirements for imports, which for the most part meet no longer modern realities of trade relations.

The main innovations, provided by the order, are:

  • The application by Ukraine of the principles of zoning and compartmentalization (this corresponds to the international practice of trade flexibility, when the import of animals or products from zones or compartments, if not the entire territory of the exporting country is free from any animal disease, is allowed), a significant decrease in the number of diagnostic studies relative to live animals to be held on the territory of the exporting country;
  • to update the requirements for the origin of raw materials for food production. The order does not establish requirements for the origin of raw materials for the processing of food products exclusively from the territory of the exporting country, which is a significant relief for producers of the indicated products;
  • to increase the variety of products that can be imported to Ukraine. So far, at the legislative level, the requirements for the import of a number of product categories have not been established, which is a significant trade barrier. The order established requirements for such new categories of products as composite products, gelatin, collagen, colostrums, frog legs and snails, 33 categories of by-products and products of their processing and cultivation.

With the adoption of this order, the former order of the State Department of Veterinary Medicine, Ministry of Agrarian Policy of Ukraine dated June 14, 2004 No. 71 “On Approval of Veterinary Requirements Concerning Import to Ukraine of State Veterinary Sanitary Control and Supervision”, registered with the Ministry of Justice of Ukraine on June 23, 2004 under No. 768/9367 (with amendments) is considered invalid.
