Simplified import of equipment for software development

Since August 4, the rules for the import of radio-electronic facilities and radiating devices (RES and IU) have changed.

The appropriate procedure for importing from abroad and selling radio electronic means and radiating devices in Ukraine is approved by the decision of the NCCR from February 13, 2018, No. 78.

The document significantly simplifies the import to Ukraine of personal computers and other electrical household goods containing RESs (including equipment and accessories required for testing and development) for carrying out special research in Ukraine (medical, scientific tests, software development, etc.). Such products can be imported without a declaration of compliance with the requirements of the Technical Regulations of Radio Equipment and/or the introduction of appropriate information on the RES into the General Register of RES.

Also, there is no need for a declaration of compliance with the requirements of the Technical Regulations for the import of amateur satellite radio stations for use in experimental research, radar, navigation systems and aviation radio electronics for the purpose of manufacturing, repairing, repairing civil aircraft or creating an exchange fund for spare parts and other equipment in accordance with the Approved List.

It is established that any product (product), which by its characteristics is intended for radiation and/or reception of radio waves or in the composition (package) of which the devices intended for this purpose are included, is considered as RES (IU).

The presence of RES in the products is denoted: Bluetooth, WiFi (or 802.11xx, where xx – letters of the Latin alphabet, or a combination thereof), GSM, 3G (or CDMA, UMTS, WCDMA, etc.), 4G (LTE, LTE-U, ), RFID (NFC), Wireless, Radio Frequency (RF, RF Transmitter), Transceiver.

RES (IU), intended for use by common users of radio frequency resources, are imported by business entities under the following conditions:

(a) availability in the General Register of RESs;

(b) the absence in the list of types (types) of RES and IU prohibited for use and importation into the territory of Ukraine, the Registry of Radio-electronic Facilities and Radiation Devices prohibited for use and importation into the territory of Ukraine (Special Register of RESs);

(c) availability of a declaration of compliance with the requirements of the Technical Regulations for Radio Equipment.

The absence of a decision by the NCCI on the introduction of RES and IU into the General Register of RESs can not be grounds for refusing to register in customs.

Citizens for personal, family and other needs not related to the performance of entrepreneurial activities may import RES (IU) in accordance with section XII of the TC, provided that such goods are not listed in the list of types (types) of RES and IP, prohibited for use and importation on the territory of Ukraine, the Special Register of RES.

The document also regulated the rules for the implementation in Ukraine of RES and IW, the forms of maintenance of the Special Register of RESs, as well as the criteria by which decisions are taken.
