New Law on Public Procurement Adopted

On 27 May 2026, the Verkhovna Rada of Ukraine adopted the new Law of Ukraine “On Public Procurement” (Draft Law No. 11520), which aims to adapt Ukrainian legislation to European Union standards.

The introduced changes are primarily aimed at creating a modern, transparent, competitive, and effective public procurement system.

Key innovations include:

  • during the term of a public contract or framework agreement, it will be possible to adjust the contract price without conducting a new procurement procedure in the event of changes in objective market factors. The price can be increased in proportion to market price rises, but by no more than 10% at a time, with no limit on the number of such increases;
  • the requirement for a mandatory minimum weight of the price criterion of at least 70% during the evaluation of tender proposals is abolished;
  • the threshold for localization requirements has been increased to UAH 1 million (subject to certain exceptions).

At the same time, during the period of martial law and for 90 days after its termination or cancellation, the specific features of procurement will continue to be determined by the Cabinet of Ministers of Ukraine.
