New Law on Housing Policy Adopted

On 13 January 2026, the Verkhovna Rada of Ukraine adopted in the second reading and in full the Draft Law “On the Basic Principles of Housing Policy” No. 12377, which launches a comprehensive overhaul of the housing sector and provides for the transition away from the outdated Soviet model of housing relations.

The Law establishes the principles and directions for the formation and implementation of housing policy, which are to be further detailed and implemented through regulatory acts and state programs, including with the involvement of local self-government bodies and business entities operating in the fields of housing construction and housing management.

Potential implications for business

  • establishing a legal framework for implementing housing projects with state participation through concessions, joint investment programs, and other public–private partnership models;
  • an orientation toward the application of financial and credit mechanisms in the construction and acquisition of housing as part of state support for the realization of the right to housing;
  • the development of approaches to affordable and social housing, in particular, through the institutionalization of the role of affordable housing operators and the establishment of principles governing their activities.

The Law pays particular attention to revolving housing funds, which may be established by local self-government bodies. Such funds have a separate balance, are not included in the general budget of territorial communities, and are used exclusively to finance housing programs.

The provisions of the law consider EU standards and norms as well as Article 47 of the Constitution of Ukraine, and create a legal framework for attracting international assistance and donor funding for the development of housing funds.

The law recognizes the Housing Code of Ukraine and the Law “On the Privatization of the State Housing Fund” as no longer in force

The document has been submitted to the President of Ukraine for signature. It will enter into force 10 days after its official publication (unless a different term is established by law).

Thus, the Law outlines the overall vector for the development of housing policy and the roles of various stakeholders in its implementation, while leaving the detailed regulation of specific mechanisms, instruments, and conditions to subsequent stages of legal regulation.
