New Procedure for Monitoring Compliance with Lobbying Legislation

October 3, 2025 The NACP by Order No. 303/25 approved the Procedure for Monitoring Compliance with the Requirements of Lobbying Legislation.

The document defines the procedure for NACP’s monitoring of compliance with lobbying legislation, aiming to verify the authenticity of information in the Register of Transparency and in lobbyists’ reports. Monitoring is also conducted to identify unregistered lobbyists or other violations of the Law “On Lobbying”. Information sources for monitoring include reports from citizens and legal entities, media, and open sources, among others.

Monitoring is conducted without undue interference and in compliance with the law on the protection of personal data. A report on a possible violation may be submitted by a natural or legal person in paper or electronic form. Such a report must contain the applicant’s details and specific facts indicating a possible violation. If the report concerns a registered entity, its registration number (identifier) in the Register of Transparency must be provided.

The decision to commence monitoring is made by the head of the NACP unit based on an official memorandum. The NACP notifies the lobbying entity about the start of the check. If inconsistencies are found during monitoring, the lobbyist has 10 working days to provide written explanations, which can be extended by another 5 days

Data sources for the check include state registers, court decisions, open databases, as well as documents obtained from applicants, government bodies, or enterprises, media, the Internet, and other sources. If a report is improperly executed, it is returned within 5 working days.

Clear monitoring deadlines have been established:

  • up to 120 days for registered lobbyists,
  • and up to 180 days for persons conducting lobbying without status.

We remind you that the Law of Ukraine “On Lobbying” came into effect in Ukraine on September 1.

The changes are aimed at enhancing the transparency of processes, creating clear control procedures for compliance with anti-corruption legislation, and ensuring stable and predictable conditions for the functioning of the lobbying market.
