The National Bank brought into compliance with the legislation a set of questions regarding the procedure for opening and maintaining accounts of bank customers.
Such rules are contained in the resolution of the Board of the NBU “On Amendments to Certain Regulatory Acts of the National Bank of Ukraine” dated January 28, 2019 No. 23.
In particular, the procedure for the use of electronic signatures on electronic documents (including electronic settlement documents) is settled. Among other things, the requirements for the creation, storage of electronic documents and the use of electronic signatures during the opening and closing of customer accounts by banks are governed by the laws “On electronic documents and electronic document circulation”, “On electronic trust services” and the regulatory act of the NBU on the use of electronic signatures in the banking system of Ukraine.
The rules regarding the submission of a card with samples of signatures by individual entrepreneurs, physical persons, engaged in independent professional activities and non-resident individuals-investors are abolished.
Banks are obliged to send a notification to GIS bodies or private contractors about an opening / closing of the accounts of individuals, registered in the Unified Register of Debtors.
A conditional storage account (escrow) must be used in the course of real estate sale and purchase transactions.This document was adopted pursuant to the requirements of the Laws “On Electronic Trust Services” and “On Introducing Amendments to Some Legislative Acts of Ukraine Regarding the Creation of Economic Premises for Enhancing the Protection of the Child’s Right to Proper Maintenance” (entered into force on November 7, 2018 and August 28, 2018, respectively ).
The Decree amended the Instructions on the procedure for opening, using and closing accounts in national and foreign currencies, the Regulation on the procedure for banks of Ukraine to saving accounts (deposit) transactions with legal entities and individuals, and the Instructions on clearing settlements in Ukraine in national currency.
Decree No. 23 entered into force on January 31, 2019.
