Agrarians Be Protected from Raiders

It is planned to make changes to 14 laws of Ukraine, aimed at a comprehensive counteraction against raiders. In particular, the information about all plots will be entered in the State Land Cadastre.

The Committee on Agrarian Policy and Land Relations recommends the Verkhovna Rada to adopt as alaw the whole bill draft No. 8121 On Amendments to the Land Code on Counteracting Raiding.

It is planned to implement protection fuses of the property rights of land owners and users in order to prevent unlawful takeover and dragging of enterprises in the agrarian sector of the economy.

A real estate owner may, by a unilateral legal transaction, require a notarized certificate of the  agreement, the subject of which is the immovable property or part of it, as well as cancel such a claim (unless the certificate is provided by the law). The requirement of mandatory notarization of the agreement is subject to registration as a charge in the State Register of Rights to Immovable Property and may be canceled at the request of the property owner.

In addition, the state cadastral registrars will be given the online access to the information contained in the registry, and the state registrars of rights – the access to the information of the State Land Cadastre.

The owners and users of land plots will no longer need to get paper extracts about land plots from the cadastre. The state registrars will have to independently compile such extracts in electronic form when implementing registration actions.

The draft law provides for the automatic extension of the land lease agreement for the same period and under the same conditions, if the condition for automatic renewal and  the leased land plot does not apply to the state or municipal property. The information on the automatic renewal of the agreements is necessarily entered in the register during the state registration of such a right. In addition, the register shall include the information on the price (value) of real estate and the right to it under the relevant agreements.
