Suspension of EU Import Duties on Ukrainian Exports Prolonged for a Year

As noted in the statement on the website of the European Parliament, 27.04.2023 the International Trade Committee gave its green light for another one-year suspension of EU import duties on Ukrainian exports to support the country’s economy (the Committee’s report was drafted by standing rapporteur for Ukraine Ms Sandra Kalniete).

Such measures are due to the assistance to Ukraine in conditions of the russian invasion.

The suspension of tariffs applies to fruits and vegetables subject to the entry price system, as well as agricultural products and processed agricultural products subject to tariff-rate quotas. Industrial products are subject to zero duties since 01.01.2023 under the EU-Ukraine Association Agreement, so they are not included in the new proposal.

The approval of such measures by the European Union Council is pending.

Updated Rules for Naming of Legal Entities

On 01.05.2023, an order of the Ministry of Justice of Ukraine dated 29.03.2023 No. 1158/5 entered into force approving new application forms in the field of state registration of legal entities, individual entrepreneurs and public organizations.

The Order also introduced the following changes to the Requirements for writing the name of a legal entity, and its separate subdivision:

  • the use of Latin alphabet letters of any other foreign language is allowed for the naming of a legal entity (previously only English was approved for use);
  • the name of a separate unit instead of the words “separate unit” (“branch”, “representative office”) should contain only the word “branch” or “representative office”.

Harmonization of Electronic Identification Schemes with EU Standards: a Resolution Adopted

On 28.04.2023, the Cabinet of Ministers of Ukraine adopted a resolution dated 28.04.2023 No. 417 that defines electronic identification schemes and levels of trust in electronic identification means in accordance with Ukrainian legislation and taking into account EU requirements.

According to the resolution, means of electronic identification issued to individuals and legal entities and their representatives must be in the electronic identification system with a corresponding level of trust in them – high, medium or low. It is also expected to approve electronic identification schemes in the future, as well as the procedure for assessing the compliance of electronic identification means in these schemes.

Also, due to the adopted decision, EU countries will be able to recognize Ukrainian electronic identification schemes in the future.

Let us please remind you that according to the Law of Ukraine “On Electronic Trust Services”, the electronic identification scheme is related to the procedure of confirming an identity for legal actions in electronic form, such as signing electronic documents.

Procedure for Booking of Military Liable Persons Optimized: Terms Clarified

28.04.2023 the Cabinet of Ministers of Ukraine adopted a resolution No. 400 dated 28.04.2023 (entered into force on 02.05.2023) that clarified periods for the authorities’ actions within the procedure for booking of military liable employees.

In particular, the following terms has been defined:

  • for submission, by state authorities and other state bodies, of lists of military liable persons offered for booking to the General Staff of the Armed Forces (SSU, Foreign Intelligence Service) –no more than 5 working days;
  • for approval of the lists and submission by the General Staff of the Armed Forces (SSU, Foreign Intelligence Service) to the Ministry of Economy –no more than 10 working days;
  • for issue, by the Ministry of Economy, of a decision on the booking of military liable employees –no more than 5 working days;
  • enrollment of a military liable employee into special military registration by the territorial recruitment and social support centre –no more than 5 working days.

Therefore, the procedure for booking a military liable employee will be conducted in a maximum of 25 working days.

Let us please remind you that on 27.01.2023, the Cabinet of Ministers adopted a new procedure for booking conscripts and criteria for determining enterprises, institutions and organizations that are critically important for the functioning of the economy and ensuring the livelihood of the population. Employees of such enterprises will be subject to the reservation from now on. More about the reservation procedure can be found in our earlier note.

Ukrainian Parliament Extended the Period of Martial Law and Mobilization for 90 Days

On 02.05.2023, the V.Rada of Ukraine supported draft laws No. 9259 and No. 9260 on the approval of the relevant Presidential decrees,which provide for the extension of martial law and general mobilization from 05:30 am on 20 May 2023 for a period of 90 days – until 18 August 2023.
