Updated Rules for the Reservation of Employees

On 03 July 2026, Resolution of the Cabinet of Ministers of Ukraine No. 862 entered into force, updating the approaches to the reservation of employees liable for military service and clarifying the criteria for enterprises granted the status of critically important for the economy.

In particular, the Resolution provides for the following:

  • enterprises recognized as critically important are obliged to submit a certificate on the average salary of employees and a tax calculation for the last month by 10 August 2026; otherwise, starting from 01 September 2026, they will lose the respective status and the right to reserve employees;
  • if an employee is concurrently employed at two critically important enterprises, they shall be included in the reservation quota exclusively of the enterprise where they have the longer employment record;
  • the requirement to adhere to the increased salary threshold for the reservation of employees of distribution system operators, coal mining and coal processing enterprises, as well as legal entities performing vital functions or providing vital energy supply services (with a state share of 90% or more), has been canceled.
