Reform of the Employee Reservation Procedure

On 02 June 2026, Resolution of the Cabinet of Ministers of Ukraine No. 692 came into force, amending the procedure for the reservation of military-liable employees and the criteria for designating enterprises, institutions, and organizations as critically important for the functioning of the economy and the state under martial law.

In particular, the following key changes are provided:

  • the minimum wage level required to confirm the enterprise’s criticality and reserve military-liable employees has been increased to 3 minimum wages (UAH 25,941 as of 2026). At the same time, the requirement for frontline areas remains at 2.5 minimum wages (UAH 21,618 as of 2026);
  • persons working part-time or who already have a deferment will be counted in the reservation quota only once, at a single place of work;
  • a review of the criticality criteria is envisaged. Authorized bodies must re-approve their criteria, after which enterprises must confirm their compliance with the updated criteria.

At the same time, a transition period is provided for businesses. The current criticality status of enterprises and the existing reservation of employees will remain valid until 01 September 2026.

However, if an enterprise was recognized as critically important based on an industry criterion that has been excluded from the updated list of criteria, the decision to grant such status will be subject to cancellation by 01 July 2026.
