Improving Сontrol over Dietary Supplements

On 27 March 2025, the Law of Ukraine No. 4122-IX “On Amendments to Certain Laws of Ukraine on Improving the Regulation of Production and Circulation of Food Supplements, Settlement of Other Issues in the Field of Healthcare” (Draft Law No. 11389) came into force, which, in particular, regulates the control over the production and circulation of food supplements (hereinafter – the “Supplements”), as well as harmonises Ukrainian legislation with the legislation of the European Union.

The Law established an obligation for market operators to submit to the State Service of Ukraine on Food Safety and Consumer Protection a notification of intention to place on the market for the first time a Supplement that was on the market in Ukraine before the Law came into force and is planned to be placed on the market after the Law comes into force within 6 months from the date of entry into force of the Law.

At the same time, the Supplements that met the requirements of the legislation on providing consumers with information on food products and the legislation in force before the entry into force of this Law, but do not meet the requirements of this Law in terms of requirements for Supplements, may be imported into the customs territory of Ukraine, produced and/or put into circulation within one year after the entry into force of this Law. Such Supplements may be in circulation until the minimum expiry date or the “best before…” date, but not longer than 3 years from the date of entry into force of this Law.

Placing Supplement on the market

Market operators will also be obliged to send to the State Service of Ukraine on Food Safety and Consumer Protection a notice of intention to place such an Supplement on the market for the first time in paper or electronic form at least 10 working days before placing it on the market.

The market operator shall acquire the right to place the Supplement on the market from the date of entering such notification into the list of notifications of the intention to place such Supplement on the market for the first time.

In the notification, the market operator shall specify the following information:

  • name of the Supplement;
  • information about the market operator;
  • personal registration number of the capacity registered in accordance with the law;
  • form of the Supplement;
  • a list of ingredients and the amount of each ingredient included in the Supplement;

If the provisions of the Law of Ukraine “On Information for Consumers on Food Products” do not require the quantity of a certain ingredient to be specified, information on such quantity is confidential. The State Service of Ukraine on Food Safety and Consumer Protection is obliged to ensure the protection of confidential information;

  • surname (if any), full name and patronymic (if any) of the person responsible for submitting the notification and further communication with representatives of the State Service of Ukraine on Food Safety and Consumer Protection regarding the information contained in the notification.

Together with the notification, the market operator shall submit a sample label (sticker) of the packaged Supplement in the state language.
