The Improvement of legislation on student self-governance

Lawyers of Syrota Dzis Melnyk & Partners have contributed to the improvement of legislation on student self-governance.

Effective self-governance is the foundation of a stable democracy. In Ukraine, the self-governance network encompasses not only territorial associations but also professional communities, including students.

The right to self-governance, guaranteed by Law of Ukraine “On Higher Education”, ensured the actual participation of students in the governance of higher education institutions, addressing issues concerning the organization of education and everyday life; the ability to protect their rights effectively; and led to the enhancement of the influence of students as public figures. However, work on improving the legal regulation of student self-governance continues.

Improving the legal regulation

Thus, as a part of the Syrota Dzis Melnyk & Partners (SDM) and Ukrainian Students League (USL) cooperation, lawyers of Syrota Dzis Melnyk & Partners with previous experience in student self-governance bodies (SSG), have joined the legislative work on improvement of the Draft Law No. 10279 ( the “Draft Law”), which is currently awaiting on its second reading.

“Regulation on the activities of student self-governance bodies should have as its priority the promotion of actual student self-governance, in particular, by diversifying the possible forms and methods of self-organization, expanding discretionary regulation, ensuring the possibility of detailization and specification of legislative norms at the level of student communities”, outlined the principles of cooperation Andrii Poleshko, Head of Commercial Practice at Syrota Dzis Melnyk & Partners.

“We devote substantial time and efforts to contribute to the development of Ukraine as a constitutional democratic European state. In this context, it is especially important to assist those who create our future – defenders of the Motherland, youth, cultural figures, and self-governing organizations”, noted Dmytro Syrota, Managing Partner at Syrota Dzis Melnyk & Partners.

A result of joint work

Proposals for amendments to the Draft Law developed as a result of joint work with the USL were submitted and are being considered by the group of the Verkhovna Rada of Ukraine’s Committee on Education, Science and Innovation.

SDM will continue to advocate for the interests of students concerning Draft Law No. 10279 within the task group of the parliamentary committee, which includes Andrii Streltsov, Junior Associate at Syrota Dzis Melnyk & Partners.
