October 18, 2025 The Cabinet of Ministers of Ukraine adopted Resolution No. 1314 “On Amendments to the Procedure for Public Procurement during Martial Law and within 90 Days after its Conclusion.”
The Resolution provides for supplementing the list of cases where contracting authorities may enter into agreements without conducting open tenders or using the electronic catalogue. This pertains to procurement of goods, works, and services for the construction, repair, and protection of critical infrastructure facilities in the life support sector.
Key changes include:
- Extension of the simplified procedure to water, heat, and electricity supply facilities;
- Application of the simplified procedure to transport and postal service facilities;
- Conducting procurement exclusively within the scope of the experimental project implementation.
During the period of martial law and 90 days after its conclusion, contracting authorities identified as “critically important” for the economy and the needs of citizens may conduct simplified procurement procedures.
The specific list of thresholds to which simplification should be applied includes:
- includes goods and services (excluding current repairs) from 100 thousand UAH,
- current repair services from 200 thousand UAH,
- and works from 1.5 million UAH.
Procurement may be conducted until March 1, 2026.
The changes are aimed at enhancing the efficiency and speed of facility restoration, establishing clear control procedures for procurement usage, and ensuring stable and predictable conditions for the functioning of life support systems.
