Procedure For Issuing International Certificates and Other Documents Required By Legislation Of Country Of Destination For Food Cargo

On 11 January 2025, the Order of the Ministry of Agrarian Policy and Food of Ukraine No. 2252 dated 26.07.2024, which approved the Procedure for Issuance of International Certificates and Other Documents Required by the Legislation of the Country of Destination for Food Cargo (hereinafter – the “Procedure”), will come into force. The approval of such a procedure was provided for in Article 60 of the Law “On Basic Principles and Requirements for Food Safety and Quality”.

The Procedure defines, in particular

  • the procedure for submitting an application by a market operator for obtaining international certificates and other documents required by the legislation of the country of destination (hereinafter – the “international certificates”) to the territorial body of the State Service of Ukraine on Food Safety and Consumer Protection or a person authorised to issue them;
  • list of required documents for issuing international certificates;
  • grounds for issuing or refusing to issue international certificates;
  • the procedure for issuing a pre-export international certificate (hereinafter – the “pre-export certificate”), which is issued at the request of the market operator in cases where the country of destination and/or the final means of transport is not determined on the date of departure from the facility of origin;
  • the procedure for replacing (reissuing) international certificates.

The Procedure also approves 15 forms of international certificates for the export of food products of animal/non-animal origin from Ukraine, which are issued at the request of the market operator in cases where there is no form of international certificate agreed by the State Service of Ukraine on Food Safety and Consumer Protection and the competent authority of the country of destination, or the country of destination does not establish the form of international certificate.

Parliament Adopts Law on Liquidation of the Commission for Regulation of Gambling and Lotteries

The mentioned Law (Draft Law No. 9256-d dated 05.04.2024) was adopted on 4 December 2024 and has now been sent to the President of Ukraine for signature.
As a reminder, the adopted Law is aimed at strengthening control in the gambling market.

The Law also provides for the following innovations:

  • by 1 April 2025, a new authorized body should be established and a ministry should be designated to formulate policy in the field of gambling and lotteries;
    introduction of a mechanism for restricting access to illegal gambling websites/mobile applications;
  • prohibitions on gambling advertising, except for the following exceptions: on TV and radio at night, in media for people over 21, on platforms and search engines with a target audience over 21;
  • prohibition of participation of military personnel, volunteers, popular personalities in advertising, as well as the use of war-related topics;
  • persons who were owners or officials of gambling companies that have a tax debt or a debt for payment of licenses are prohibited from obtaining a license;
  • allowing foreign entities with relevant experience to obtain a license to conduct state lotteries.

Parliament Postpones Enactment of the Law on Lobbying

According to the NACP, in accordance with paragraph 31 of the Final Provisions of the Law of Ukraine “On the State Budget of Ukraine for 2025”, amendments were made to Section III “Final Provisions” of the Law of Ukraine “On Lobbying”, which entered into force in March this year, pursuant to which the Law “On Lobbying” shall be enacted no later than 1 September 2025, and the establishment and operation of the Transparency Register shall be ensured within 14 months from the date of entry into force of the Law, i.e. in May 2025.

This decision was made due to the need to conduct a broad information campaign to explain the provisions of the Law and the specifics of its application before the Law becomes effective.

We would also like to remind you that on October 16, the Government adopted a resolution “Some Issues of Establishment and Functioning of the Transparency Register”, by which it approved the Regulation on the Transparency Register, and in early October 2024, it approved the Rules of Ethical Conduct for Lobbying Entities.
