Changes to the Employee Rezervation, Reactivation of the Registers of the Ministry of Justice

Changes to the Employee Rezervation Procedure via the Diia Portal

On 14 January 2025, the Cabinet of Ministers of Ukraine adopted Resolution No. 36, which amended the Procedure of Reservation of Persons Liable for Military Service for the Period of Mobilisation and Wartime, which was approved by the Cabinet of Ministers of Ukraine by Resolution No. 76 dated 27 January 2023.

The new amendments allow companies with critical infrastructure status to change reservation of employees until 01 March 2025, without having to wait 72 hours between the expiration of the previous reservation and the new one, through the Diia portal.

In addition, the government allowed full employee reservation for medical institutions of state and municipal ownership, which were previously limited to 50% of the number of conscripts.

The government also granted the Ministry of Communities and Territories Development the right to approve the list of non-governmental organizations that implement humanitarian projects funded by international partners.

Reactivation of the Unified and State Registers of the Ministry of Justice

On 20 January 2025, the press service of the Ministry of Justice of Ukraine informed that the functioning of the Unified and State Registers had been restored following a large-scale cyber attack by the russian federation.

The following registers have been reactivated:

  • the State Register of Proprietary Rights to Immovable Property;
  • the State Register of Movable Property Encumbrances;
  • the Automated Enforcement Proceedings System;
  • the Electronic Register of Apostilles;
  • the Unified Register of Convicted Persons and Persons in Custody;
  • the Automated System “Bankruptcy and Insolvency”;
  • the Unified State Register of Persons Subject to the Law of Ukraine “On Government Cleansing”.

During the period of data actualisation regarding encumbrances by state and private enforcement officers, access to the State Register of Real Property Rights has been restricted for notaries and state registrars.

Government Has Approved Draft Law To Amend The Market Surveillance Legislation.

On 20 January 2025, the Verkhovna Rada registered Draft Law No. 12426 proposed by the Cabinet of Ministers of Ukraine on amendments to market surveillance legislation aimed at implementing European safety and consumer protection standards in Ukraine.

The press service of the Ministry of Economy reported that the Draft Law proposes, inter alia, the following changes:

  • extending state market surveillance to e-commerce;
  • strengthening consumer protection through the implementation of European standards for non-food products;
  • introducing requirements for authorised representatives for certain product categories, particularly electrical equipment, personal protective equipment, and toys.

Additionally, the Draft establishes a new import control mechanism through the implementation of clear algorithms for interaction between customs and market surveillance authorities via the Single Window mechanism, and provides for expanded cooperation opportunities between market surveillance authorities, business associations, consumers, and customs.

Draft Laws On Taxation Of Foreign Parcel

On 20 January 2025, the Verkhovna Rada registered Draft Laws No. 12429 and No. 12430, proposing amendments to the Customs and Tax codes of Ukraine aimed at improving the taxation of import parcels and simplifying customs procedures.

According to the Chairman of the Verkhovna Rada Committee on Finance, Taxation and Customs Policy, all goods purchased on international online platforms (AliExpress, Temu, etc.) will be subject to VAT regardless of their value.

At the same time, customs duties will only be charged on goods valued over 150 euros. Additionally, goods sent by individuals for non-commercial purposes and valued at less than 45 euros will not be subject to VAT.

Another important change is the introduction of the Import One-Stop Shop (IOSS) mechanism, implemented in the EU in 2021, which will allow suppliers or platforms to pay VAT directly. This will significantly simplify customs procedures and reduce processing times
