Law on Partial Resumption of Documentary Tax Audits Published

On 07.12.2023, Law No. 3453-IX on the partial resumption of tax audits was published in the newspaper “Holos Ukrainy”.

The Law comes into force on 01.12.2023, but not earlier than the day following the day of its publication. Thus, the Law will enter into force on 08.12.2023.

We would like to remind you that the Law provides for the resumption of documentary scheduled audits in the period from 08.12.2023 to 31.12.2024, in particular for taxpayers in the field of production and/or sale of excisable goods, gambling, financial or payment services.

The Cabinet of Ministers Adopted a Resolution on the Register of Damages

On 01.12.2023, the Cabinet of Ministers adopted Resolution No. 1256 and Order No. 1107-p, prepared by the Ministry of Justice, concerning the operation of the International Register of Damages Caused by the Russian Aggression against Ukraine.

In particular, the Resolution defines the approach to the classification of losses and damage, which will be proposed to be taken into account when creating rules and regulations governing the work of the Register.

Losses will be categorized according to the subject matter in the following groups:

  • Category (A): individuals;
  • Category (B): the state of Ukraine, including central and local authorities, state-owned or controlled institutions;
  • Category (C): legal entities, enterprises, including state-owned enterprises, critical infrastructure enterprises, and individual entrepreneurs.

Along with this, the Order ensures that all measures necessary for the operation of the Register in Ukraine are taken, including the granting of a free right to use technical requirements for the development of the Register software and the possibility of submitting applications for reimbursement through the Diia Portal.

The New Procedure for Warranty Repair or Warranty Replacement of Technically Complex Household Goods Came into Force

On 05.12.2023, the Procedure for determining the mechanism of interaction between consumers, manufacturers of technically complex household goods, sellers, service centers during warranty repair or warranty replacement of goods, approved by the Cabinet of Ministers Resolution No. 1251, came into force.

The new Procedure, in particular, provides for the provision of warranty obligations to the consumer by the manufacturer in electronic form by registering the purchased goods on the manufacturer’s official website, as well as providing the consumer with access to download operational documents from the relevant website.

It is also expected that the launch of such a mechanism will reduce the burden on business by abolishing paper forms that sellers were required to fill out when providing warranty service.

In addition, the Procedure establishes a list of complex household goods, which include, in particular:

  • electronic household appliances;
  • household appliances and devices;
  • vehicles;
  • medical products.

The NBU Allowed the Sale of Foreign Currency Cash in Unlimited Amounts

On 30.11.2023, the NBU Board Resolution No. 155 cancelled all restrictions for banks and non-bank financial institutions on the amount of foreign currency cash they can sell to the public.

This is expected to help stabilize exchange rate expectations and increase the stability of the foreign exchange market.
