Prohibitions of Use of Palm Oil, 5 More New Services in Diia

President Signs Law on Restricting the Use of Palm Oil

On 06 November 2024, the President of Ukraine signed the Draft Law No. 5148 on improving the quality of food products consumed by children, which provides, inter alia, for prohibitions of use of palm oil.

The Law enters into force on the day following the day of its publication and will put into effect one year after its publication.

At the same time, food products that meet the requirements of the legislation on safety and certain food quality indicators in force prior to the entry into force of this Law, but do not meet the requirements of this Law, may be in circulation until the final date of consumption or expiration of their shelf life.

New List of Goods not Subject to Return is Approved

On 1 November 2024, the Cabinet of Ministers of Ukraine adopted Resolution No. 1243, by which it approved the List of Goods Not Subject to Exchange (Return).

The List was adopted in accordance with Law No. 3153-IX “On Protection of Consumer Rights” dated 10.06.2023 and enters into force simultaneously with the entry into force of this Law, i.e. immediately after the termination or abolition of martial law.
This list provides that the following goods are not subject to exchange (return):

  • food products;
  • medicinal products;
  • personal care products (toothbrushes, hair brushes, eyelash or nail brushes, shaving aftershaves, personal care brushes, manicure, pedicure tools and other similar products);
  • goods trimmed or cut to the size specified by the consumer.

Also, Resolution of the Cabinet of Ministers of Ukraine No. 172 dated 19 March 1994 ‘On Implementation of Certain Provisions of the Law of Ukraine “On Protection of Consumer Rights”, which approved the List of Seasonal Goods, the warranty periods for which are calculated from the beginning of the respective season; the List of Goods from which the exchange fund is formed; and the List of Goods of Good Quality Not Subject to Exchange (Return), will cease to be effective.

Resumption of Certain Types of Business Inspections

On 5 November 2024, the Cabinet of Ministers adopted Resolution No. 1264, which approved amendments to Resolution No. 303 dated 13.03.2022 “On the Termination of State Supervision (Control) and State Market Supervision under Martial Law”.

The document provides for the resumption of planned measures of state supervision (control) over compliance by business entities with:

  • legal requirements for the quality of medicinal products;
  • Licensing conditions for conducting economic activities on cultivation of plants included in Table I of the list of narcotic drugs,
  • psychotropic substances and precursors, as well as activities on development, production, manufacture, storage, transportation,
  • acquisition, sale (release), importation into the territory of Ukraine, exportation from the territory of Ukraine, use, destruction of narcotic drugs, psychotropic substances and precursors included in the said list;
  • Licensing conditions for conducting business activities for the production of medicinal products, wholesale and retail trade in medicinal products, import of medicinal products (except for active pharmaceutical ingredients).

The respective amendments will enter into force on 01 January 2025.

Extension of martial law and mobilization until 07 February 2025

On 07 November 2024, the laws on the extension of martial law No. 4024-IX and general mobilization in Ukraine No. 4025-IX were officially published.

The term of martial law in Ukraine and the term of general mobilization was extended from 10 November 2024 for 90 days, i.e. until 07 February 2025.

Beta Test of 5 More New Services in Diia

On 05 November 2024, the Ministry of Digital Transformation launched 5 more new services for business in a beta test format as part of the e-Entrepreneur service on the Diia portal.

The following documents can now be submitted through this electronic service

  • notification of the use of a single account;
  • notification of hiring an employee;
  • application for registration of a cash register;
  • application for registration of an electronic cash register;
  • notification of taxable objects.
